Anyone in Indiana know the laws on this?
I have a friend who just had her son 3 weeks ago. She married a man when she was really young but has been divorced from him for years and just never got around to changing her last name. 
Well last year she got pregnant by a guy that didn't want a baby and she didn't really want to be with him so they split ways and she is not a wonderful single mother. WELL, when baby was born she went to put the name on the BC and put her maiden name (the name she wants baby to have) and the birth clerk told her she wasn't legally allowed to do that because she was single?
So she was literally forced to give the baby the last name of her ex husband even though he has nothing to do biologically or physically with the child. 
I feel like this is soooooo wrong, and illegal. Aren't you supposed to be able to give your child any first, middle, and last name that you want? 
Does anyone KNOW the legal facts about this for the state of Indiana?

I don't know about other states, but here in CO, they don't care what last name the baby has. My husband and I haven't changed our names yet (yes, we're both changing our names lol. We both hate our current last names, so when we are able, we're changing them to his mother's last name). To make things easier in the future, we went ahead and gave our son the last name we will eventually have. They let us do it even though neither of us currently have that last name.

Yep. And since she never changed her name back to her maiden name... Then that's the name baby will have

Now he has the last name of someone who isn't even his parent. 
she is so upset about it too. 
I was always told you can name your child what ever you want.

She may be able to change his name after they've filed everything. Again, not sure on the laws there, but it might be something to look into.

Im not married, never have been, and 3 of my kids have a different last name than me.

yeah but is their father on the birth certificate? Its different if their is no father present.

Here you have to be married to the father or have a blood test proving he's the father or else the child is given mothers last name

That law really sucks for people that live in IN.
I'm still legally married but when I had my first son with SO I put SO's last name. I legally had to list my husband as the father but I could give the baby any name I wanted.
