I have to consent for the Drug test yes, as do all mothers. However if the mother test positive I have never known of them needing her permission to test the baby. What mother would refuse to be tested? I suppose some might, but I never had one single patient refuse to be tested. Even the ones who knew they would test positive. I guess some hospitals may not test everyone, but they do here.
When I found out I was pregnant I was smoking weed but, immediately quit. At my OB appt she asked about drug use and what-not and I told her how I did smoke but, I had quit and she told me, they will test me..but, they never did. I think it's a scare tactic but, I also think if they're suspicious that you are a drug user they can..but, I'm not sure about that either.

I did a nursing rotation in L&D. In this hospital the doctors did test the mothers for drugs, but they were concerned about drugs that would cause the baby to have withdrawals, not marijuana. If the mother tested positive then they would test the baby. If they were only positive for marijuana, CPS would not be called or involved at all. They are more concerned with prescription pills, cocaine, and things of that nature that will cause serious withdrawals from the infant. In the time I was there, there were many mothers who tested positive for marijuana and nothing was done about it. The hospital that I go to for my pregnancy does not even test the mother unless there is some reason to. I have not been tested at all. Every hospital has different policies but I can assure you they will not just take the baby is she tests positive for marijuana.
I think its funny that whenever someone claims that someone had their baby taken away, its always a story. Ive never read of anyone who ACTUALLY had their own baby taken away. I think its all stories.
If theres anyone who can come forward and actually tell me that their OWN baby was taken away and prove it somehow then maybe Ill believe it, otherwise, I think its all a folk tale

They may have already tested her @ an prenatal visit. If shes has had a + drug screening then they will test her again after the birth and possibly test the baby. If she passes the drug test they usually send baby home and open a case with follow up visits and parenting/drug counseling. Its rare in MO for children to be taken from their parents for marijuana because our system is so overloaded. Especially if this is the first time. This coming from my cousin. She is an intake worker for Mo division of family svcs. And this happened with my little sister. DFS came and did home visits w the baby and stuff. Just tell her to quit now and be honest w them.
At the hospital where I work (in VA), they only test the baby if the mother comes up positive for drugs. And even if the baby does test positive, they don't take the baby unless she has a record of being an unfit mother. CPS would be called and they would devise a parenting plan with her and do home visits to check in on her and the baby. It is very rare that they actually take the baby from the hospital.
my friend sarah campbell had her baby taken away for having weed & co-lad-a-pins in the babies system they checked the placenta without permission we live in ohio so yes they can do it and she only had her baby for 2 days in the hospital the police and CPS showed up questioned her gave her options about what would happen & what she could do and the baby ended up being taken into foster care... so yes it happens maybe not where you live but it can happen.

This just happened to my brother and his fiancee. She was late getting into the doctors because of medicaid and so toward the end of her pregnancy the hospital told her they would drug test the baby and herself. Well she stopped smoking about a month maybe longer I could be wrong before she had the baby and they tested her at the hospital she was clean, then they tested my neice the meconium (sp?) and she came up positive. Cps never got involved at the hospital because she was transferred to a childrens hospital but a few days after she came home a social worker was calling their phone. My SIL had to go meet with her where she gave her another test ( she was clean) and they set up a home visit so they could come out and see the house which happened to be today and they tested her again. So far they have decided to not open a case. Good Luck, It's just not worth it and it's not fair to the baby. Also even if she stopped it stays in the baby's system from like 16 weeks on.

Klonopin is a prescribed medication. Very similar to xanax. But stronger. So adding that to this equation makes it more than just testing positive for THC... Especially considering I doubt she had a Rx for it...

In California, they test at your first appt..If you have a positive test for THC they continue to test the whole pregnancy. When my daughter was born I was confronted by a social work about a positive THC test at 9 weeks but never had another one after that. They threatened me with CPS but we never heard from them.
Most states now test your babies meconium as soon as they're born. And smoking pot doesn't make your friend a bad person, but her choices COULD HAVE severely affected her baby in many different ways. Its not a matter of whats 'better' for you, its a question of how selfish are you going to be while your MAKING ANOTHER PERSON, that has no choice over what you do.. I do hope everything works out for your friend though!
She was more than likely drug-tested at her appts for it when they test for sugars, etc in her urine. If they found it at anytime, they could test the baby. If it is a baby boy, they just tap a special bag (I have no idea what it is called!) onto the baby to get urine from them. Not exactly sure what they do if it is a girl. I just know about the way they test a boy because my cousin went through all of these a few years ago. If the baby tests positive for drugs, they will call in CPS to monitor the situation. They usually do not take the child unless they see that the mother is unfit to parent.
If your friend is worried about it, she should stop smoking now. It should be out of her system as well as the baby's system by the time she delivers.
